DOCTOR REPORTS 22,000 PEOPLE COULD HAVE BEEN SAVED HAD FDA ACTED MORE QUICKLY TO REMOVE TRASYLOL FROM MARKET

February 15, 2008—Dennis Mangano, Ph.D., M.D. says 22,000 lives could have been saved had Trasylol been removed from the market when he first published a study linking the drug to kidney failure and widespread death.

Dr. Mangano alleged that Bayer failed to disclose to the FDA at an advisory panel meeting in September 2006 that the drugmaker had conducted its own research which confirmed the conclusions from his January 2006 study.

Asbestos Lawsuits

From the turn of the century through the 1970s, asbestos was widely used in the United States as an insulation and fireproofing material. Each year, workers applied hundreds of thousands of tons of asbestos in a variety of jobs.

Those who worked with and around these workers were exposed to asbestos dust. Most workers did not wear respirators or other protective equipment because they were not warned that asbestos was deadly. As a result, there has been a steady increase in asbestos-related diseases, including mesothelioma.

Our lawyers are experienced in litigating asbestos lawsuits. Among our numerous accomplishments is a $7.5 million jury award in a case where our client was diagnosed with mesothelioma as a result of asbestos exposure at his workplace.

Permax Recall

March 29, 2007—The FDA announced Permax would be withdrawn from the market over concerns of serious heart valve damage.

Patients taking Permax should immediately contact their physicians to discuss alternative treatments. The FDA warns that patients should not stop taking the medication before speaking with their doctor, as abruptly stopping Permax can be dangerous.

The recall comes after two studies published in the New England Journal of Medicine found that Permax patients were at increased risk of regurgitation (backflow of blood) of the mitral, tricuspid, and aortic valves of the heart.

Wrongful Death Verdict

August 23, 2006—A jury awarded $5.1 million to the family of a man who was killed while performing community service.

Vince Currid was a student at Emory University who had been sentenced to 40 hours of community service after a DUI conviction. His sentence required him to work on the back of a garbage truck.

Currid was not trained for the dangerous work and was not provided with boots or rain gear on the rainy day. Currid fell from the truck and struck his head. He died from his injuries one month later.

Currid's family filed a lawsuit against the county. Sam Starks and Clint Sitton of Martin & Jones represented the family.

lawsuits help guarantee drug safety

Lawsuits can serve as "a vital deterrent" and protect consumers if drug companies do not disclose risks to the U.S. Food and Drug Administration before it approves medicines for use, the editors of the New England Journal of Medicine said in a friend-of-the-court brief. The FDA "is in no position" to guarantee drug safety, the brief said.
